To the extent that intellectual property rights subsist in their original wording, structure, organisation, selection, arrangement, presentation or accompanying material, those rights belong to SK Education Services Ltd.

Copying Our Policies

Our policies may deal with subjects which other examination centres, educational organisations or businesses are also required to address.

This does not give another organisation the right to copy our protected original material.

Where copyright subsists, another organisation must not copy all or a substantial part of our original policy wording, structure or protected presentation and then:

  • publish it on its own website;
  • place its own business name upon it;
  • use it as its own policy;
  • distribute it to its own customers;
  • incorporate it into commercial documentation;

  • provide it to another examination centre;

Changing business names, addresses, headings or a small number of words does not necessarily mean that protected material has not been copied.

Trade Mark Rights

INTUITION EXAM CENTRES® is a registered trade mark owned by SK Education Services Ltd.

Associated registered logos, devices, graphical marks or other registered branding belonging to SK Education Services Ltd are also protected by applicable trade mark law.

Our trade marks are valuable business assets.

No person or organisation may use an Intuition Exam Centres registered trade mark without our permission where that use would infringe our registered rights.

Use of the Intuition Exam Centres® Name

Unless we have provided prior written permission, no person or organisation may use INTUITION EXAM CENTRES® or confusingly similar branding in a way which:

  • infringes our registered trade mark rights;
  • suggests that another business is Intuition Exam Centres;
  • creates a likelihood of confusion;
  • suggests an official connection with us where none exists;
  • falsely suggests endorsement by us;
  • falsely suggests that another venue is operated by us;
  • misrepresents another organisation as part of SK Education Services Ltd;
  • diverts customers through confusion;
  • imitates our branding in a misleading manner; or
  • otherwise unlawfully exploits the reputation associated with our brand.

Logos and Branding

Our logos, brand graphics, distinctive visual identity and associated brand materials must not be:

  • copied;
  • reproduced;
  • redrawn;
  • modified;
  • altered;
  • imitated;
  • republished;
  • incorporated into another organisation’s branding;
  • used in advertisements;
  • placed on another website;
  • used on social media accounts; or
  • used to promote another business

without our prior written permission, except where the use is otherwise permitted by law.

Permission to refer to Intuition Exam Centres does not automatically include permission to reproduce our logo.

No False Affiliation

No person may use our intellectual property in a way which falsely suggests that they:

  • are Intuition Exam Centres;
  • represent Intuition Exam Centres;
  • are operated by SK Education Services Ltd;
  • are an Intuition Exam Centres branch;
  • are an authorised Intuition Exam Centres examination venue;
  • are our franchisee;
  • are our partner;
  • have been approved by us;
  • are endorsed by us; or
  • otherwise have a commercial relationship with us

unless that relationship genuinely exists.

The content appearing on the Intuition Exam Centres website is provided for legitimate use by candidates, parents, guardians, educational professionals and other users interested in our services.

Access to our website does not transfer ownership of any intellectual property to the visitor.

Unless permitted by law or authorised by us in writing, users must not:

Protected Intuition Exam Centres intellectual property must not be commercially exploited without prior written authorisation from SK Education Services Ltd.

Prohibited activities may include:

  • republishing our material on a commercial website;

Where a substantial protected part of an original work has been reproduced, questions of infringement may arise even where:

  • words have been substituted;
  • paragraphs have been rearranged;
  • headings have been changed;
  • names and addresses have been replaced;
  • sections have been shortened;
  • formatting has been altered; or
  • material has otherwise been adapted.

Whether infringement has occurred will depend upon the particular material and applicable law.

Nothing in this Policy claims exclusive ownership of ideas, facts, general concepts, legal obligations or examination regulations which cannot themselves be protected by copyright or another intellectual property right.

For example, we do not claim that another examination centre is prohibited merely from:

  • offering examination services;
  • following JCQ rules;
  • complying with awarding organisation requirements;
  • having a privacy notice;
  • having cancellation terms;
  • having a cookie policy;
  • offering access arrangements;
  • publishing examination guidance; or
  • operating a similar general business model.

Our rights relate to the protected intellectual property belonging to SK Education Services Ltd, including original expression, branding, registered trade marks and other protected materials.

Domain Names and Online Identity

Our registered trade marks and branding must not be incorporated without authority into:

  • domain names;
  • website names;
  • social media usernames;
  • social media pages;
  • advertising accounts;
  • online marketplace profiles;
  • directory listings;
  • email addresses; or
  • other digital identifiers

where the use infringes our rights, creates confusion or falsely suggests association with Intuition Exam Centres.

We reserve the right to take appropriate action in relation to infringing or misleading domain names and online accounts.

Search Advertising and Online Promotion

Our trade marks must not be used in advertising or promotional activity in a manner that infringes our rights or misleads consumers about the identity or origin of services.

This may include misleading use within:

  • search advertising;
  • paid advertisements;
  • social media advertisements;
  • website metadata;
  • online listings;
  • marketing campaigns;
  • promotional pages; or
  • other digital advertising.

Databases and Collections

Intuition Exam Centres may own copyright, database rights or other rights in qualifying collections and databases created or maintained by us.

Where such rights apply, users must not without permission systematically extract or reuse all or a substantial part of protected database material.

Repeated extraction of smaller parts may also be restricted where applicable law provides protection.

Automated Scraping

Unless authorised by us or permitted by law, users must not use automated technology to systematically copy or extract protected Intuition Exam Centres material for unauthorised commercial purposes.

This may include:

  • bots;
  • crawlers;
  • scraping software;
  • automated downloading tools;

  • similar technologies.

Names, logos and trade marks belonging to examination boards, awarding organisations, JCQ or other organisations remain the property of their respective owners.

Reference to an awarding organisation on our website does not imply ownership by Intuition Exam Centres of that organisation’s intellectual property.

Likewise, no third party may rely upon this Policy as permission to use intellectual property belonging to an awarding organisation.

Linking to Our Website

Ordinary links to publicly accessible pages on our website are permitted provided that the link:

  • is lawful;
  • accurately identifies the destination;
  • is not misleading;
  • does not falsely imply endorsement;
  • does not falsely imply partnership;

  • preserving evidence of the infringement;
  • contacting the person or organisation concerned;
  • issuing a formal request to cease the activity;
  • requiring removal of infringing material;
  • requesting destruction of unauthorised copies;
  • submitting copyright or trade mark infringement notices;
  • submitting takedown requests to website hosts;
  • submitting complaints to search engines;
  • submitting complaints to social media platforms;
  • reporting infringing advertisements;
  • challenging infringing domain names;
  • obtaining professional legal advice;
  • negotiating an appropriate licence or settlement where appropriate;
  • seeking an injunction;
  • seeking damages or other financial remedies;
  • seeking recovery of profits where legally available;
  • seeking recovery of legal costs where available; and
  • commencing legal proceedings.

The particular remedies available will depend upon the nature of the infringement and applicable law.

SK Education Services Ltd may maintain records relating to the creation, ownership, use and development of its intellectual property.

Such records may include:

  • original files;
  • dated drafts;
  • website archives;
  • publication dates;

  • design files;
  • correspondence;
  • invoices;
  • contracts;
  • licence agreements;
  • development records;
  • archived web pages; and
  • other evidence relevant to ownership.

We may also monitor publicly available sources where reasonably necessary to identify suspected misuse of our intellectual property.

No Transfer of Rights

Accessing the Intuition Exam Centres website, purchasing an examination, completing an application or receiving documentation from us does not transfer intellectual property ownership to you.
